Terms of Service.
YOUR BRAND. YOUR GROWTH. PLEASE READ THESE TERMS CAREFULLY BEFORE ENGAGING OUR DIGITAL MARKETING AGENCY SERVICES OR ACCESSING OUR PLATFORM. BY USING ESTRASMEDIA, YOU AGREE TO BE BOUND BY THESE TERMS AND SERVICE STANDARDS.
EstrasMedia Vision & Purpose
EstrasMedia is a full-service performance marketing, social media management, and ad strategy agency. Our mission is to empower e-commerce brands, info-product creators, and local businesses to scale traffic, optimize ad campaigns (ROAS), and manage client communications seamlessly on a unified platform.
Section 1 - Scope of Services & Campaign Management
EstrasMedia provides digital advertising, media buying, content production, search engine optimization, and client CRM management software. All deliverables, monthly retainers, and advertising campaigns managed by EstrasMedia are tailored to specific growth frameworks chosen by the client.
Section 2 - Client Assets & Ad Budget Responsibility
Clients are responsible for maintaining valid billing credentials on ad networks (Meta, TikTok, Google, YouTube). Ad platform spend is directly billed by third-party ad channels to the client’s funding source and is completely separate from EstrasMedia agency setup or management retainer fees.
Section 3 - Intellectual Property & Content Rights
All custom creative assets, video recordings, graphics, and copies designed for client campaigns remain client property upon full payment of retainer fees. EstrasMedia retains the right to display anonymized performance case studies and campaign analytics for marketing and agency portfolio demonstration.
Section 4 - Retainers, Subscriptions & Payment Gateways
Monthly retainers, software licenses, and recurring service tiers are processed through encrypted payment gateways (PayFast / Card Payments). Services are billed on a recurring monthly billing cycle. Cancellations require advance written notice prior to the start of the next renewal cycle.
Section 5 - Social Media Automation & Connected Accounts
Our social media automation service lets a client connect social accounts that they own or are authorised to manage (for example a Facebook Page, an Instagram professional account or a TikTok account). By connecting an account, the client authorises EstrasMedia to publish content to that account on their behalf, following the content plan set up in their dashboard. We only use the permissions you grant (such as permission to post), and only to deliver the service you subscribed to. You can disconnect an account at any time from your dashboard, or by removing EstrasMedia's access in the settings of the platform itself (Facebook, Instagram or TikTok).
Section 6 - AI-Assisted Content & Client Responsibility
Some posters, images and captions are created with the help of AI tools, based on the business information, images and instructions the client provides. The client is responsible for the accuracy of that information and confirms that they have the right to use any logo, photo or other material they supply. AI-assisted content may occasionally contain mistakes, and clients should review their published posts. Content that is unlawful, misleading, hateful, infringes the rights of others, or breaks platform rules is not permitted.
Section 7 - Third-Party Platforms
Connected accounts remain subject to the terms and policies of each platform, including those of Meta (Facebook and Instagram) and TikTok. EstrasMedia is an independent company and is not affiliated with, endorsed by or sponsored by any of these platforms. A platform may limit, remove or reject content, change what it allows, or suspend or disconnect an account, and publishing may be interrupted when that happens. We are not responsible for decisions made by a third-party platform.
Section 8 - Your Data & Privacy
We handle personal information in line with our Privacy Policy, including the access details that let us post to your connected accounts. Please read the Privacy Policy, which forms part of these Terms.
Section 9 - Suspension, Cancellation & Changes
We may pause or end the service for an account that breaks these Terms or platform rules. Clients may cancel according to Section 4, after which we stop publishing to their connected accounts. Our Refund Policy explains when refunds apply. We may update these Terms from time to time, and the version published on this page applies from its effective date.
Section 10 - Performance Disclaimer & Limitation of Liability
While EstrasMedia utilizes advanced algorithmic targeting and proven growth strategies to maximize Return On Ad Spend (ROAS), digital market factors and ad platform policies remain subject to fluctuate. EstrasMedia shall not be held liable for third-party ad platform suspensions, account policy changes, or indirect market fluctuations outside our technical control.
Section 11 - Governing Law
These Terms of Service and all agency solutions provided by EstrasMedia shall be governed by and construed in accordance with the laws of the Republic of South Africa.
